Welcome to Tryst. These Terms of Service ("Terms") constitute a legally binding
agreement between you ("you," "your," or "User") and MindBerzerk
("MindBerzerk," "Tryst," "we," "us," or "our") governing your access to and use
of the Tryst platform, including our website at jointryst.com,
mobile applications, services, features, content, subscriptions, virtual goods,
communications, and related offerings (collectively, the "Service").

By accessing, downloading, registering for, or using the Service, you acknowledge
that you have read, understood, and agree to be bound by these Terms and our
Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

1. Eligibility

You may use the Service only if:

• You are at least eighteen (18) years of age;


• You have the legal capacity to enter into a binding agreement;


• You are legally permitted to use the Service under applicable laws;


• You have not previously been suspended or permanently banned from the Service.

By using Tryst, you represent and warrant that you meet all eligibility

2. Account Registration

You agree that:

• Share or transfer your account;


• Sell, lease, or trade access to your account.

3. Nature of the Service

Tryst is a social discovery and dating platform intended to help adults connect.

We do not guarantee:

• Matches;


• Messages;


• Relationship outcomes;


• Compatibility;


• Availability of any specific users;


• Real-world interactions;


• User behavior or conduct.

Tryst provides technology tools only and is not responsible for interpersonal
outcomes between users.

4. User Content

You retain ownership of content you submit, including profile photos, profile text,
bios, interests, messages, stories, videos, audio, comments, prompts, verification
submissions, reports, and other uploaded materials ("User Content").

By submitting User Content, you grant MindBerzerk a worldwide, non-exclusive,
royalty-free, sublicensable, transferable license to host, store, reproduce,
process, adapt, display, distribute, publish, moderate, analyze, format, and
transmit such content as necessary to operate, improve, promote, secure, and
provide the Service.

You represent that:

• You own or control necessary rights;


• Your content does not violate law;


• Your content does not infringe third-party rights;


• Your content is not defamatory, obscene, fraudulent, or unlawful.

We may remove content at our discretion.

5. Community Rules

You agree not to engage in illegal, abusive, fraudulent, harmful, or platform-abusive conduct.

Illegal Conduct

• Violate laws;


• Promote illegal activity;


• Traffic prohibited goods or services.

Abuse & Harassment

• Harass users;


• Threaten users;


• Intimidate users;


• Stalk users;


• Bully users;


• Abuse users.

Sexual Exploitation

• Solicit minors;


• Request explicit content unlawfully;


• Exploit users sexually;


• Engage in coercive conduct.

Fraud

• Scam users;


• Impersonate individuals;


• Solicit money deceptively;


• Run romance scams;


• Misrepresent identity.

Commercial Misuse

• Advertise products without authorization;


• Spam users;


• Recruit users commercially;


• Solicit investments;


• Run lead generation.

Platform Abuse

• Create fake accounts;


• Evade bans;


• Manipulate metrics;


• Scrape data;


• Reverse engineer the Service;


• Interfere with systems.

Harmful Content

• Hate speech;


• Extremist content;


• Violent threats;


• Defamatory content;


• Unlawful explicit content.

Violations may result in warnings, suspensions, content removal, restrictions,
or permanent bans.

6. Safety Disclaimer

You are solely responsible for your interactions with other users.

MindBerzerk does not conduct criminal background checks on all users. Verification
status does not guarantee authenticity, safety, honesty, intentions, or identity
beyond the verification process used.

Users may provide inaccurate or misleading information. If you choose to meet
another user offline, you do so entirely at your own risk.

You should exercise caution, including:

• Meeting in public places;


• Informing trusted contacts;


• Protecting personal information;


• Independently verifying identities.

MindBerzerk shall not be liable for conduct of users, whether online or offline.

7. Messaging & Communications

The Service may permit messaging and communication features.

You acknowledge that:

• Communications may be moderated;


• Automated abuse detection may review content;


• Reported content may be reviewed by moderators;


• Abusive communications may be restricted.

We do not guarantee delivery, retention, or availability of messages.

Messages may expire, be deleted, or become inaccessible.

8. Matching & Recommendation Systems

Tryst may use algorithms, automation, ranking systems, behavioral signals,
engagement indicators, location signals, preference signals, or other technical
methods to recommend users, rank profiles, prioritize visibility, and personalize
discovery.

We do not guarantee fairness, neutrality, compatibility, or equal visibility.
Features such as boosts or paid promotions may affect visibility.

9. Location Features

Certain features may rely on approximate or precise location information. By
enabling location-based features, you consent to our use of location data for
Service functionality.

Location accuracy may vary. You are responsible for device permission settings.
We do not guarantee location precision.

10. Verification

Tryst may offer profile verification, identity verification, photo verification,
or other trust features.

Verification indicates only that certain verification steps were completed
according to our processes.

Verification does not guarantee:

• Identity authenticity in all contexts;


• Future conduct;


• Legitimacy;


• Safety;


• Intentions.

Verification may be revoked at any time. Certain verification features may
require payment. Verification fees, where applicable, are generally non-refundable
except where required by law.

11. Paid Features

The Service may offer paid digital features, including:

• Subscriptions;


• Premium access;


• VIP memberships;


• Boosts;


• Coins;


• Super likes;


• Visibility promotions;


• Verification services;


• Consumable virtual goods;


• Non-consumable digital upgrades.

Pricing may change at any time. Prices may vary by region, platform, or
promotional campaign. All purchases are subject to platform billing provider
rules where applicable.

12. Subscriptions

Recurring subscriptions automatically renew unless canceled before renewal.
By purchasing a subscription, you authorize recurring charges.

Subscription billing may be handled through:

• Apple App Store;


• Google Play;


• Web payment providers;


• Other authorized billing systems.

Cancellation must be completed through the billing platform used. Deleting your
account does not automatically cancel subscriptions. Subscription access may
continue until the current billing term expires.

13. Virtual Goods

Coins, boosts, super likes, and similar digital items:

• Have no cash value;


• Are non-transferable;


• Are non-redeemable;


• May expire if disclosed;


• May be revoked for policy violations.

MindBerzerk may modify, discontinue, or replace digital goods. Except where
required by law, purchases are final. Unused digital items are not refundable.

14. Refunds

Refund eligibility is governed by:

• Applicable law;


• Apple App Store rules;


• Google Play rules;


• Payment processor policies.

Where purchases are made via third-party platforms, refund requests must
generally be directed to that platform. Except where legally required, consumable
digital purchases are non-refundable.

15. Advertising

The Service may display advertisements, sponsored placements, or promotional
content. We are not responsible for third-party advertiser content, products,
offers, or representations.

Interactions with advertisers are solely between you and the advertiser.

16. Third-Party Services

The Service may integrate with third-party services, including identity providers,
hosting providers, payment providers, analytics tools, mapping services, push
notification services, or advertising providers.

Use of such services may be governed by separate terms. MindBerzerk is not
responsible for third-party services.

17. Content Moderation

We may:

• Review reports;


• Remove content;


• Restrict features;


• Restrict profile visibility;


• Suspend accounts;


• Permanently terminate access;


• Deny reinstatement.

Moderation decisions may be made manually or through automated systems. We are
not obligated to provide warnings.

18. Appeals

Where appeal mechanisms are provided, submission of an appeal does not guarantee
reinstatement. MindBerzerk retains discretion regarding enforcement outcomes.

19. Intellectual Property

All Service content excluding User Content, including branding, logos, designs,
interfaces, source code, software, databases, text, and graphics, are owned by
MindBerzerk or its licensors.

No rights are granted except as expressly stated.

You may not copy, modify, distribute, scrape, decompile, reverse engineer, or commercially exploit the Service without written authorization.

20. Copyright Complaints

If you believe content infringes your intellectual property rights, contact:

Please include:

• Identification of the copyrighted work;


• Details of the allegedly infringing material;


• Your contact details;


• A good-faith statement;


• A statement confirming your authority to submit the complaint.

21. Account Termination

You may stop using the Service at any time.

We may suspend, restrict, or terminate access immediately if:

• You violate these Terms;


• We suspect fraud;


• We detect abuse;


• Legal compliance requires action;


• Operational or security concerns arise.

Termination may result in loss of content, access, and digital items.

22. Disclaimers

The Service is provided "as is" and "as available."

To the maximum extent permitted by law, MindBerzerk disclaims all warranties,
including merchantability, fitness for a particular purpose, non-infringement,
availability, security, reliability, and accuracy.

We do not guarantee:

• Uninterrupted service;


• Error-free operation;


• Perfect security;


• Match success;


• User authenticity.

23. Limitation of Liability

To the maximum extent permitted by law, MindBerzerk shall not be liable for
indirect, incidental, consequential, punitive, special, or exemplary damages,
including emotional distress, lost profits, lost data, reputational harm, or
interpersonal harm arising from user interactions.

Our total liability shall not exceed the greater of amounts you paid to
MindBerzerk in the prior twelve (12) months or USD $100.

24. Indemnification

You agree to indemnify and hold harmless MindBerzerk, its affiliates, officers,
contractors, employees, licensors, and agents from claims arising out of your use
of the Service, your User Content, your conduct, violations of these Terms, or
violations of third-party rights.

25. Changes to the Service

We may modify, suspend, restrict, discontinue, or replace any part of the Service
at any time. Features may be added, removed, or restructured without notice.

26. Changes to These Terms

We may update these Terms periodically. Updated Terms become effective upon
posting unless otherwise stated. Continued use after updates constitutes
acceptance.

27. Severability

If any provision is held invalid or unenforceable, remaining provisions remain
effective.

28. Waiver

Failure to enforce any right does not waive that right.

29. Entire Agreement

These Terms, together with incorporated policies, constitute the entire agreement
between you and MindBerzerk regarding the Service.
