Tryst End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legally binding agreement between
you ("you," "your," or "User") and MindBerzerk ("MindBerzerk,"
"Tryst," "we," "us," or "our") governing your installation, download, access,
and use of the Tryst software application, website services, mobile applications,
and related software components (collectively, the "Software").

This EULA applies whether you access the Software directly from
jointryst.com, through an official app marketplace, or through
any authorized distribution channel.

By downloading, installing, accessing, or using the Software, you acknowledge
that you have read, understood, and agree to be bound by this EULA.

If you do not agree to this EULA, you must not install, access, or use the
Software.

1. License Grant

Subject to your compliance with this EULA, MindBerzerk grants you a limited,
personal, revocable, non-exclusive, non-transferable, non-sublicensable license
to install, access, and use the Software solely for your personal,
non-commercial use in connection with the Tryst Service.

This license does not transfer ownership of the Software.

You may:

• Install the Software on devices you own or control;


• Use the Software for lawful personal use;


• Access software updates made available by MindBerzerk.

2. Restrictions

You may not, directly or indirectly:

• Copy, reproduce, duplicate, or redistribute the Software except as expressly permitted;


• Modify, adapt, translate, alter, or create derivative works from the Software;


• Reverse engineer, decompile, disassemble, decode, or attempt to discover source code;


• Bypass, disable, or interfere with security mechanisms or access controls;


• Rent, lease, sublicense, lend, sell, assign, distribute, or commercially exploit the Software;


• Use automated tools, bots, scripts, crawlers, or scraping technologies against the Software;


• Remove copyright, trademark, proprietary notices, or branding;


• Use the Software to violate applicable law or third-party rights;


• Use the Software for fraudulent, abusive, or harmful conduct;


• Attempt unauthorized access to systems, servers, APIs, databases, or user accounts.

3. Eligibility

The Software is intended solely for individuals who are at least
18 years of age.

By using the Software, you represent and warrant that:

• You are at least 18 years old;


• You have legal capacity to enter into binding agreements;


• Your use of the Software complies with applicable law.

4. Account Access

Certain features require account registration and authentication.

You are responsible for:

• Maintaining confidentiality of login credentials;


• All activity occurring under your account;


• Promptly notifying us of unauthorized use.

MindBerzerk may suspend, restrict, or terminate account access for violations of
this EULA, our Terms of Service, or applicable law.

5. Software Updates

MindBerzerk may release patches, bug fixes, enhancements, upgrades, or modified
versions of the Software at any time.

Certain updates may be required for continued access or compatibility.

By using the Software, you consent to automatic or required updates where
supported by your platform.

6. Ownership & Intellectual Property

The Software is licensed, not sold.

MindBerzerk and its licensors retain all right, title, and interest in and to
the Software, including:

• source code;


• application logic;


• user interface designs;


• graphics;


• logos;


• branding;


• trademarks;


• copyrights;


• databases;


• software architecture;


• related intellectual property rights.

No ownership rights are transferred to you under this EULA.

7. Third-Party Software & Services

The Software may rely on third-party frameworks, SDKs, APIs, hosting providers,
analytics tools, authentication providers, payment providers, mapping services,
advertising services, and operating system components.

Such third-party services may be governed by their own terms and policies.

MindBerzerk is not responsible for third-party software or services.

8. Availability

MindBerzerk does not guarantee uninterrupted availability, uptime, performance,
compatibility, or error-free operation.

Access may be suspended for maintenance, upgrades, technical failures, abuse
prevention, legal compliance, or operational reasons.

9. User Data

Use of the Software may involve processing of personal information and user
content in accordance with our Privacy Policy and Terms of Service.

You are responsible for maintaining appropriate device security, including
passwords, operating system security, and safe device access.

10. Mobile Platforms

If you download the Software from Apple App Store or Google Play, additional
platform provider terms may apply.

Apple Inc. and Google LLC are not parties to this EULA and are not responsible
for the Software except as required under their platform rules.

11. Termination

This EULA becomes effective when you first install, access, or use the Software
and remains in effect until terminated.

MindBerzerk may terminate or suspend this license immediately if:

• You violate this EULA;


• You violate the Terms of Service;


• Fraud or abuse is suspected;


• Security risks arise;


• Legal compliance requires action;


• The Software is discontinued.

Upon termination:

• Your license ends immediately;


• You must stop using the Software;


• You must uninstall/delete copies where applicable;


• Access to associated services may be revoked.

12. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDBERZERK DISCLAIMS ALL WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING:

• merchantability;


• fitness for a particular purpose;


• non-infringement;


• availability;


• security;


• accuracy;


• reliability;


• performance.

MindBerzerk does not warrant that the Software will be uninterrupted, secure,
error-free, or compatible with every device or platform.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDBERZERK SHALL NOT BE LIABLE FOR:

• indirect damages;


• incidental damages;


• consequential damages;


• special damages;


• punitive damages;


• loss of data;


• loss of profits;


• business interruption;


• device damage;


• service interruptions.

TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

• AMOUNTS PAID BY YOU TO MINDBERZERK IN THE PRIOR TWELVE (12) MONTHS; OR


• USD $100.

14. Indemnification

You agree to indemnify, defend, and hold harmless MindBerzerk, its affiliates,
officers, contractors, employees, licensors, and agents from claims, liabilities,
losses, damages, expenses, and legal fees arising from:

• Your use of the Software;


• Your violation of this EULA;


• Your violation of law;


• Your infringement of third-party rights.

15. Export Compliance

You agree not to use, export, re-export, or transfer the Software in violation
of applicable export control laws or sanctions regulations.

16. Changes to this EULA

MindBerzerk may update this EULA periodically.

Updated versions become effective upon posting unless otherwise stated.
Continued use constitutes acceptance.

17. Severability

If any provision is found invalid or unenforceable, remaining provisions remain
in full force and effect.

18. Waiver

Failure to enforce any right or provision shall not constitute waiver.

19. Entire Agreement

This EULA, together with the Terms of Service and Privacy Policy, constitutes the
complete agreement between you and MindBerzerk regarding the Software.
